STANDARD TERMS AND CONDITIONS OF SALE
Definitions
Seller: Histoires de Cigares SA, Grand Rue
64, CH-1110 Morges, Switzerland.
Buyer / Customer: any natural or legal person making a purchase online at
histoiresdecigares.com or lescigares.com.
Order: any purchase request validated on the website.
Products: cigars, accessories, spirits and other items offered for online sale.
2. Scope of Application
These Terms and Conditions apply exclusively to online sales made on histoiresdecigares.com and lescigares.com. They do not apply to purchases made in our physical store.
3. Prices and Shipping Costs
All prices are indicated in Swiss Francs
(CHF), VAT included, for deliveries within Switzerland and Liechtenstein.
For deliveries abroad, prices are shown excluding VAT and customs duties, which
remain the responsibility of the customer.
Shipping costs are automatically calculated at checkout.
Free shipping thresholds:
- Switzerland: from CHF 150
- Europe: from EUR 300
- Rest of the world: as calculated at checkout.
4. Orders and Confirmation
Any order placed online implies acceptance
of these Terms and Conditions.
The sales contract is concluded upon receipt of the order confirmation sent by
email.
5. Payment
Payment is due immediately and must be made
using one of the methods offered on the site (credit card, Twint, bank
transfer, etc.).
The seller reserves the right to request additional documents in case of
suspected fraud.
6. Product Availability
We make every effort to keep product
availability up to date.
In case of unavailability, the customer will be contacted promptly to choose
between:
- delayed delivery,
- a substitute product,
- or an immediate refund if the substitution is not accepted.
7. Product Information
Descriptions, specifications, and images
provided on the site are for information purposes only and have no contractual
value.
The authenticity and quality of the products are guaranteed by Histoires de
Cigares SA.
8. Delivery
Once payment has been received, indicative
delivery times are 48 hours within Switzerland and 7–10 business days
internationally.
The goods are handed over to the carrier on behalf of the customer. The risk of
loss, delay, or damage passes to the customer at that point.
In case of an issue upon receipt (damaged parcel, missing product), the
customer must notify the seller by email within 48 hours, with supporting
photos.
Tracking information is provided upon request.
Delays due to the carrier, customs, or force majeure (strikes, weather,
blockages) cannot be attributed to the seller.
9. Claims and Returns
All claims must be made within 48 hours of
receipt, with supporting photos or videos.
Returns are accepted only for objective defects or delivery errors.
Returns are not accepted for subjective reasons (e.g. personal taste).
Returned products must be intact, unused, and in their original packaging.
If a return is validated, the seller will provide a refund or replacement.
10. Order Cancellation / Modification
An order may be cancelled or modified as
long as it has not been shipped.
Once shipped, no cancellation or modification is possible.
Administrative fees may be charged if the order is already being prepared.
11. Quality and Storage
All cigars are guaranteed authentic and are stored under optimal conditions (19-21°C, 72% humidity). Each box is shipped sealed with a passive humidification system.
12. Legal Warranty
The Swiss legal warranty against hidden defects (Art. 197 ff. CO) applies.
13. Intellectual Property
All site content (texts, images, logos, trademarks) is protected by copyright and remains the exclusive property of Histoires de Cigares SA. Any unauthorized use is prohibited.
14. Data Protection
Your personal data is used solely to
process your order and is only shared with partners necessary for contract
execution (carriers, payment providers).
In accordance with the Swiss Federal Data Protection Act (nLPD), you have the
right to access, rectify, and delete your data.
A separate Privacy and Cookies Policy is available on the site.
15. Legal Age
The sale of tobacco and spirits is
prohibited to persons under 18 years of age.
By placing an order, the customer confirms that they are over 18.
16. Force Majeure
The seller is not liable for non-performance or delays in case of force majeure (natural disasters, strikes, customs blockages, network outages, etc.).
17. Amendments to the Terms
The seller reserves the right to amend
these Terms and Conditions at any time.
The applicable version is the one published on the site at the time of the
order.
18. Applicable Law and Jurisdiction
These Terms and Conditions are governed by
Swiss law.
Any dispute is subject to the exclusive jurisdiction of the courts of the
Canton of Vaud.
